Adventures in Prosecuting Tyco

From an article in today’s WSJ on the pending mistrial declaration in the fraud trial of Tyco exec, Dennis Kozlowski:



In a highly unusual move, a juror in the trial appeared to make an “OK” gesture in the direction of the defense table as she filed into court Friday morning. Juror No. 4, a retired lawyer named Ruth Jordan, made the gesture as she brushed back her hair. It was widely noticed in the courtroom, although apparently not by the judge. The gesture appeared to signify solidarity with the defense.

    Can you say “jury tampering”?
    If Swartz and Kozlowski were willing to pay $16,000 for an umbrella stand, I wonder what they would spring for a hung jury?

    You’re not alone. I saw a comment from one lawyer tracking the trial who said that the action was bizarre, “like something out of a John Grisham novel”.

    That’s exactly what I’m thinking. This woman has been paid off, big time. The Feds will haunt her every nickle from this day on, and she’ll never get away with it. Unfortunately, the defendents may.
